UPEV, the Union of Promoters and Entrepreneurs of Vaping, has launched a judicial process against the General Administration of the State with which it requests the cessation and rectification of the institutional advertising campaign “El Tabaco Ata y Te Mata en todos sus Formas” , promoted by the Ministries of Health and Consumption since 2019.

The organization considers that the campaign identifies “in a manifestly misleading” vaping and smoking, “equating both activities and attributing the same harmful effects to them”. For two years, the aforementioned portfolios have disseminated a discourse against tobacco consumption and smoking prevention, highlighting that this constitutes the main preventable public health problem in developed countries. It is, according to reports, the leading cause of preventable mortality and morbidity in our country and the rest of the surrounding countries.

UPEV considers that with this message the Ministry of Health disseminates information and makes statements that, from a scientific point of view, are not true. As they explain, the identification of tobacco and vaping only causes confusion among citizens and they point out that, according to what was published by Public Health England in 2015, personal vapers are 95% less harmful than tobacco. Thus, the organization “frontally” rejects the position of Health for “being false and lacking the minimum required rigor”.
The process has been undertaken, according to UPEV, after numerous claims of withdrawal or modification of the campaign. “The requests of the sector have not been listened to. For this reason, we are now resorting to legal means to defend truthful public information and to safeguard the interests of a sector that has always maintained a firm commitment to scientific endorsement ”, stated Arturo Ribes, President of the Union of Promoters and Entrepreneurs Vaping.
However, during this time, the communication has received various criticisms from various user organizations and the UPEV itself, which has filed complaints with the Ombudsman. As a result, the Commission and the Ministry of Health recognized that vaping is not a way of consuming tobacco.
